These Terms of Service (“Terms”) are an agreement between you and MKG Enterprise (“Giddit”, “we”, “us”), which operates the Giddit website and app at giddit.app (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Giddit
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms, and you may not make purchases or run advertising without that person’s permission.
2. Your account
You can sign up with an email address and password or with your Google account. Keep your information accurate and your password secure. You are responsible for activity on your account. Tell us at support@giddit.app if you believe it has been used without your permission.
3. Your content
You keep ownership of what you add to Giddit: lists, items, photos, descriptions, profile details and anything else (“Your Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and share Your Content only as needed to run the Service — for example, showing a list to the people you share it with, or showing public items to other users. This licence ends when you delete the content or your account, except for copies held briefly in backups or already shared with others under your settings.
You are responsible for Your Content. Only upload material you have the right to share. Visibility settings control who can see your lists; content you make public can be seen by anyone using the Service.
4. Acceptable use
You agree not to:
- break the law or help anyone else do so;
- post content that is sexual, violent, hateful, harassing, or that infringes anyone’s rights;
- impersonate anyone, or misrepresent your connection to anyone;
- invite people to lists, Secret Santa or other games unless you have a reason to believe they would expect to hear from you;
- send spam, or use the Service for unsolicited marketing;
- scrape, crawl or copy the Service or its data by automated means, or interfere with its security or operation;
- use the Service to build a competing product, or resell access to it.
We may remove content or restrict accounts that break these rules.
5. Gift lists, reservations and games
Giddit helps you save and share gift ideas, lets others mark an item as reserved, and runs gift exchanges such as Secret Santa. Reservations and game results are a coordination aid between people you know; they are not orders, and we do not guarantee that anyone will buy, deliver or receive a gift.
6. Products, prices and other websites
Giddit does not sell the products shown on it. Product details, prices and images come from retailers or from users, may change at any time and may be inaccurate. Purchases happen on the retailer’s website under the retailer’s own terms, and we are not responsible for them. Some links may be affiliate links, which means we may earn a commission if you buy through them, at no extra cost to you.
7. Etsy
The term 'Etsy' is a trademark of Etsy, Inc. This Application uses Etsy's API, but is not endorsed or certified by Etsy.
DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY MKG ENTERPRISE (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
8. Paid features
Giddit Premium
Giddit Premium is a one-time purchase that unlocks premium features for the life of your account. The price is shown before you pay. Payments are processed by Stripe; we do not see or store your full card number. If you believe you were charged in error, contact us.
Advertising
Businesses can run ads in the Discover feed. Ads must follow these Terms and pass our review, and we may reject, pause or remove any ad. Charges are shown when you create a campaign and are billed through Stripe. Advertisers are responsible for their ads and the pages they link to.
9. Ending your use
You can stop using Giddit at any time, and delete your account and its data yourself in Settings (or by emailing support@giddit.app). Deleting cancels any games you host and stops any ads you run; see the Privacy Policy for what is kept. We may suspend or end your access if you break these Terms or if we need to in order to protect the Service, its users or others. Sections 3 (as to content already shared), 7, 10, 11 and 12 survive.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT PRODUCT INFORMATION ON IT IS ACCURATE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MKG ENTERPRISE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow these limits, so they may not apply to you.
You agree to indemnify MKG Enterprise against claims arising from Your Content, your ads, or your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Maryland, and you and we consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms. If a change is material, we will tell you in the Service or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
